The Rules of Civil Procedure in Ontario have been amended to allow Judges to more readily decide lawsuits on a motion, without the need for an actual trial. These processes have been embraced by the Supreme Court of Canada, which has called for their use wherever possible to make litigation faster and less expensive.
We embrace the Culture Shift when it comes to summary judgement motions. We argued the first summary judgment motion brought in a lien action after the recent Rule change and have now successfully argued a number of such motions.
